Terms of Service

Effective Date: Immediately upon account creation or use of the Service.

These Terms of Service ("Terms") constitute a legally binding agreement between Silovik Engine ("Company," "we," "us," or "our") and you ("Customer," "you," or "your") governing your access to and use of the Silovik anti-bot detection and traffic filtering platform (the "Service").

1. ACCEPTABLE USE — LEGITIMATE PURPOSES ONLY

The Service is designed and licensed exclusively for legitimate, lawful purposes. By using the Service, you represent and warrant that:

• 1.1 You will use the Service solely in compliance with all applicable local, state, national, and international laws, regulations, and treaties.
• 1.2 You will NOT use the Service for any illegal, fraudulent, deceptive, malicious, or unauthorized purpose, including but not limited to:
• (a) Phishing attacks, credential harvesting, or social engineering schemes;
• (b) Distribution of malware, ransomware, viruses, or malicious code;
• (c) Identity theft, impersonation, or unauthorized access to computer systems;
• (d) Hosting or facilitating fraudulent websites, scam pages, or deceptive content;
• (e) Any activity that violates the Computer Fraud and Abuse Act (CFAA), GDPR, CAN-SPAM Act, or any equivalent legislation in your jurisdiction;
• (f) Harassment, stalking, threats, or distribution of non-consensual intimate media;
• (g) Copyright infringement, trademark violation, or intellectual property theft;
• (h) Any activity that causes harm, financial loss, or damage to third parties.
• 1.3 You are solely responsible for all traffic routed through the Service and all content hosted on any servers connected to the Service.
• 1.4 You acknowledge that we do not review, monitor, or endorse the content, destinations, or purposes for which you configure the Service.

2. CUSTOMER RESPONSIBILITY & INDEMNIFICATION

• 2.1 You agree to defend, indemnify, and hold harmless Silovik Engine, its officers, directors, employees, agents, affiliates, and successors from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
  • (a) Your use or misuse of the Service;
  • (b) Your violation of these Terms or any applicable law;
  • (c) Any content, websites, or materials you route, host, or distribute using the Service;
  • (d) Any third-party claims related to your activities conducted through the Service;
  • (e) Any investigation, legal action, or enforcement proceeding initiated against you as a result of your use of the Service.
• 2.2 If we receive a legal request, subpoena, or law enforcement inquiry related to your account or traffic, we reserve the right to fully cooperate with authorities, including disclosing account information, logs, and configuration data.

3. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

• 3.1 We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• 3.2 We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will detect all bots or malicious traffic.
• 3.3 We make no guarantees regarding the effectiveness of the Service against any particular threat, bot, or malicious actor.
• 3.4 You acknowledge that no security system is impenetrable and that the Service is one component of a defense-in-depth strategy.

4. LIMITATION OF LIABILITY

• 4.1 Silovik Engine, its officers, directors, employees, and agents shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
  • (a) Your use or inability to use the Service;
  • (b) Any conduct or content of any third party using the Service;
  • (c) Unauthorized access, use, or alteration of your transmissions or content;
  • (d) Any bugs, viruses, or other harmful code that may be transmitted through the Service;
  • (e) Any errors or omissions in the Service's operation or documentation.
• 4.2 In no event shall our total aggregate liability exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100.00), whichever is greater.

5. ACCOUNT TERMINATION & ENFORCEMENT

• 5.1 We reserve the right, at our sole discretion and without prior notice, to suspend or terminate your account and access to the Service if we believe, in good faith, that you have violated these Terms or any applicable law.
• 5.2 We may immediately terminate accounts involved in phishing, malware distribution, fraud, or any activity that poses a threat to our infrastructure or reputation.
• 5.3 Upon termination, your right to access the Service ceases immediately. Data associated with your account may be retained for legal compliance purposes or deleted at our discretion.
• 5.4 No refunds will be issued for accounts terminated due to Terms violations.

6. SUBSCRIPTION & PAYMENT

• 6.1 Subscription fees are non-refundable except as required by applicable law.
• 6.2 We may modify pricing with thirty (30) days' notice. Continued use after a price change constitutes acceptance.
• 6.3 Crypto payments are final and processed at the exchange rate at time of confirmation.

7. INTELLECTUAL PROPERTY

• 7.1 The Service, including all software, code, algorithms, designs, documentation, and branding, is the exclusive property of Silovik Engine and is protected by copyright, trade secret, and other intellectual property laws.
• 7.2 You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purpose during the term of your active subscription.
• 7.3 You may not reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service, except as expressly permitted by applicable law.

8. PRIVACY & DATA

• 8.1 Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
• 8.2 The Service processes visitor data (IP addresses, user agents, browser fingerprints) for the purpose of bot detection. You are responsible for obtaining any necessary consents from your visitors for such processing.

9. COMPLIANCE WITH LAW ENFORCEMENT

• 9.1 We will cooperate with valid legal process from law enforcement and government agencies.
• 9.2 We reserve the right to report illegal activity to appropriate authorities without prior notice to you.

10. GOVERNING LAW & DISPUTES

• 10.1 These Terms shall be governed by and construed in accordance with the laws applicable to the jurisdiction where the Company is registered, without regard to conflict of law principles.
• 10.2 Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.
• 10.3 You waive any right to participate in a class action against the Company.

11. CHANGES TO TERMS

• 11.1 We reserve the right to modify these Terms at any time. Material changes will be communicated via email or dashboard notice.
• 11.2 Continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

12. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
